Overview

Mr. Scholler is a Director located in the Houston, Texas office. He is part of the firm’s Disputes, Claims and Investigations Practice, which is dedicated to assisting clients in the following service areas: complex insurance claims, litigation support, data analytics and corporate recovery.

Mr. Scholler has 20 years of experience preparing insurance claims, providing litigation support and consulting clients on a wide variety of matters in various industries, including refining, petrochemical, power generation, retail, service, hospitality, construction and manufacturing. His experience includes the preparation of claims for business interruption, property damage, extra expense, delay-in-startup and builder’s risk matters, as well as the quantification of damages in support of litigation arising from insurance disputes.

Prior to joining The Claro Group, Mr. Scholler was an Associate Director with Navigant Consulting where he focused most of his time assisting energy clients in their insurance recovery efforts. Prior to that, he was an Assistant Vice President with Marsh where he focused on non-energy related insurance matters, such as hospitality, retail and service industries. He also developed significant experience in builder’s risk and delay in start-up claims while working extensively on several high profile claims.

Power Generation

Claro professionals prepared and managed various business interruption, extra expense and property damage claims for a Fortune 500 company that is one of the largest power generation and retail electricity businesses in the United States. They serve 16 states and have numerous assets operating in different regional electricity markets across the country. Assets include natural gas, oil and coal fired cogeneration and combined cycle power plants.

Refinery

Claro professionals prepared and managed the business interruption, extra expense and property damage claims for a refinery that lost its crude unit as a result of a fire. The refinery bypassed the crude tower and utilized the vacuum tower to process crude, which allowed the refinery to continue operating, albeit at a reduced capacity.

Lubes Refinery

Claro professionals prepared and managed the business interruption and extra expense claim for a lubes refinery in Vicksburg, West Virginia. The client lost their crude unit as a result of a fire. To mitigate their losses, they were able to purchase crude and other feedstocks to run through the downstream units; albeit, at much lower processing rates. The major issue was the calculation of the ADV deductible because of ambiguous language. One interpretation yielded a deductible that was one-third the value of the other.

Terminaling and Transportation

Claro professionals prepared and managed the business interruption and property claim for one of the largest independent liquids terminal and pipeline operators in the country as a result of flooding from super storm Sandy. The main point of contention was whether or not the insured would need to replace the sand foundation due to saltwater intrusion for all the tanks that lifted due to the storm surge.

Midstream

Claro professionals prepared and managed the business interruption claim for a midstream company in Tulsa, Oklahoma. The loss was the result of a ruptured natural gas pipeline that was owned by Enbridge and was the sole source of natural gas for the facility.

Public Universities

Claro professionals prepared and managed the business interruption and extra expense claims while assisting on the property damage/ FEMA claims after hurricane Katrina struck New Orleans in August 2005. The main components of analysis on the claims were lost tuition and fee revenue, increased revenue from grants and donations and cost savings as a result of the universities being shut down. FEMA trailers were provided on a temporary basis for staff and students once the universities reopened resulting in a mitigation of the loss of tuition and fees. However, there were two major complicating factors in the business interruption recovery: saved expenses and operating margins.

Builder’s Ris

Claro professionals prepared and managed the builder’s risk claim for a National Football League stadium which sustained damage from an earthquake while under construction.

Retail

Claro professionals prepared and managed the business interruption, inventory and property damage claims for a fashion accessory boutique chain that provides affordable earrings, necklaces, bracelets, handbags, scarfs, etc. The store was located within a mall, and the loss was the result of smoke and water damage due to a fire at a store next door.

Political Risk

Claro professionals prepared and managed the political risk insurance claim for an international Fortune 200 exploration and production company. The claim arose from an expropriatory act of a South American country. The expropriatory act involved a 99% tax levied by the foreign country on total crude production from any current and future oil wells.
