Jeff Andrien is a Managing Director with The Claro Group and the leader of the firm’s Austin, Texas office. He is a nationally-recognized expert in the areas of economics and finance, with over 20 years of experience analyzing issues pertaining to antitrust, commercial damages, intellectual property, securities, valuation, and related areas. Jeff has authored a number of expert reports and has testified in state and federal courts throughout the country. 

In addition to his consulting responsibilities, Mr. Andrien works as an adjunct professor both domestically and abroad; teaching graduate-level courses in finance, economics and marketing.

Prior to joining The Claro Group, Mr. Andrien was the President of a national consulting firm specializing in litigation consulting and economic analysis. Jeff has also worked in the investment banking and hospitality industries.    

Experience +

Linda Suchanek, et al v. Sturm Foods Inc., and Treehouse Foods, Inc.

The Claro Group was retained by attorneys from Foley and Lardner on behalf of the defendant, Treehouse Foods, to evaluate the plaintiff’s damages claim in a class action lawsuit alleging false advertising, under the Lanham Act. Mr. Andrien testified in a written report and at deposition that the plaintiff’s claimed “full refund” damages were inappropriate and overstated. Mr. Andrien also conducted an affirmative analysis to demonstrate that consumers were not overcharged. The case is currently pending in District Court in the Southern District of Illinois.

TinicumCapital Partners II, L.P., et al v. Liberman Broadcasting, Inc. et al

The Claro Group was retained by Latham and Watkins in this valuation dispute in the Court of Chancery of the State of Delaware. The plaintiff’s suit against Claro’s client, Liberman Broadcasting, Inc. et al, was related to the 2016 FCC Incentive Spectrum Auction.  Claro Managing Director, Jeff Andrien, issued an expert report and testified at deposition about the expected value to Liberman Broadcasting, Inc of engaging in the FCC Auction under different participatory strategies. 

Bear Ranch, LLC v. Heartbrand Beef, Inc. American Akaushi Association, and Ronald Beeman

The Claro Group was retained by attorneys at Vinson & Elkins on behalf of the defendant and counter-plaintiff, Heartbrand Beef, Inc. et al.  The case was tried before a jury in Judge Gregg Costa’s court in the Southern District of Texas, Victoria Division.  Mr. Andrien testified in deposition and at trial to the value of a heard of Akaushi cattle and to economic  damages related to breach of contract and fraud claims.  The jury found Claro’s client not guilty of the claims against it and awarded the client approximately $25 million in damages on its counterclaim.    

Memory Lane, Inc. v. Classmates International, Inc., d/b/a Classmates, et al.

The Claro Group was retained by attorneys at Foley and Lardner to perform liability and damages analysis in a Trademark Infringement case.  Managing Director, Jeff Andrien, testified in deposition and at trial, on behalf of defendant, Classmates International, that plaintiff experts had not proven a likelihood of confusion and, even assuming liability, that damages were de minimis.  The case was tried in front of a jury in Judge Josephine L. Staton’s court in the Central Distric of California, Southern Division.  Claro’s client was found not guilty of trademark infringement and, accordingly, was not assessed any damages. 

Surgiquest, Inc. v. Lexion Medical, LLC

The Claro Group was retained by the law firm, Baker Botts, counsel for the defense and counter-plaintiff in this case.  Managing Director, Jeff Andrien, issued a report and testified in deposition regarding damages resulting from alleged false/misleading advertising and tortious interference in the market for medical devises for laparoscopic surgery.  The case is slated for trial in the USDC for the District of Delaware in April 2017.

Giddy Up, LLC v. Prism Graphics, Inc. et al.

The Claro Group was retained by counsel, DiNovo Price and Ellwanger, on behalf of Giddy Up, LLC.  Claro Managing Director, Jeff Andrien, testified at trial to damages related to an intellectual property dispute.  The jury awarded Mr. Andrien’s damages amount to Claro’s client, Giddy Up. 

Economic Study of the Global Crude Oil Market

The Claro Group was retained by a large, international oil company to perform an econometric study of the global crude oil market.  The engagement was led by Managing Director, Jeff Andrien, in conjunction with academic affiliates, Dr. Kenneth Hendricks and Dr. Robert Porter.  Claro’s work entailed estimating the world demand for crude oil in order to obtain own and cross-price elasticities between crude and hydrocarbons that are not perfect substitutes.
