Ross Mishkin is a Managing Director with The Claro Group located in Chicago. Ross is a nationally-recognized expert in the areas of commercial insurance claims analysis, insurance allocation, and damages calculations in complex insurance claim disputes. He has performed damages analyses and developed complex allocations in both a testifying expert and privileged consulting capacity in various state and federal jurisdictions across the country.
Ross specializes in providing complex claims consulting related to commercial insurance disputes and class actions. Ross has assisted many corporations and their legal counsel on a variety of complex litigation matters and class actions, including damages calculations, insurance claim allocations, insurance offsets in CERCLA recovery cases, retrospective premium plan calculations, insurance receivable reserving analyses, statistical sampling, and claims exposure estimations.
Ross has extensive experience analyzing and evaluating insurance programs dating back to the 1940’s through today, including coverage with retrospective premium plans, fronting arrangements, and captive programs
John Crane, Inc., v. Allianz et al
The Claro Group was retained by attorneys from Anderson Kill on behalf of the plaintiff, John Crane. Mr. Mishkin testified in a written report, at deposition and at trial to quantify outstanding claims payments, determine trigger dates for allocation, and allocate asbestos products bodily injury damage amounts to historical general liability insurance coverage. Allocated claims under Illinois law. The case is currently pending in the Circuit Court of Cook County, Illinois.
U.S. Silica Company v. ACE Fire Underwriters Insurance Company, et al
The Claro Group was retained by attorneys from K&L Gates on behalf of the plaintiff, US Silica. Mr. Mishkin testified at deposition and trial to quantify and allocate recoverable silica bodily injury claims to certain primary insurance policies. Performed statistical analysis to verify the accuracy and reliability of claims information including exposure dates.
Appleton Papers Inc. and NCR Corporation v. George A. Whiting Paper Company, et al.
The Claro Group was retained by a group of attorneys from Latham & Watkins, Greenberg Traurig, and Quarles & Brady on behalf of a joint defense group. Mr. Mishkin testified in a written report, at deposition and at trial as a testifying expert to determine how much, if any, insurance offsets were appropriate relating to a CERCLA PRP contribution action at the Fox River Superfund Site. The case is currently pending in the US District Court Eastern District of Wisconsin.
Jean Smith and Lorie Ivie et al v. United American Insurance Company et al
The Claro Group was retained by Zuckerman Spaeder on behalf of the Class plaintiffs. Mr. Mishkin provided written testimony valuing certain insurance policy products offered to each Class member as part of a Class Settlement. Analyzed settlement values for more than 45,000 individual Class claimants.
In Re: National Collegiate Athletic Association Student-Athlete Concussion Injury Litigation
The Claro Group was retained by Latham & Watkins on behalf of the defendant, NCAA. Mr. Mishkin provided written testimony analyzing the financial adequacy proposed class action settlement fund. The matter involves settlement of NCAA concussion class action and proposed Medical Monitoring Program, and is currently pending in the US District Court for the Northern District of Illinois Eastern Division.

The Claro Group was retained by Kirkland & Ellis on behalf of the defendant, BP. Mr. Mishkin testified in a written report to determine if historical Amoco insurance general liability settlement recoveries constitute a double recovery for amounts Amoco previously recovered from the Minnesota Petroleum Tank Release Compensation Board.
Insurance Recovery Settlement Project
The Claro Group was retained by an international chemical company to assist it in recovering asbestos bodily injury claim costs from its historical liability insurers. Mr. Mishkin led a settlement team that successfully recovered over $300 million in policy commutations, and agreed to a comprehensive coverage-in-place (CIP) agreement with an additional $750 million in covered limits. Claro continues to administrate the CIP and manage quarterly insurer billings.
